Use of the Website is governed by this Usage Agreement (“Agreement”), and your use of the Website, including viewing, downloading, uploading, or interacting with the Website in any way, will be construed as your acceptance of the Agreement.

Any use or reference on the Website to J-W Power Company or its products or services is for informational purposes only.  Subject to this Agreement, J-W Power Company grants the user of the Website a non-exclusive, non-transferable, limited right to access, use and display the Website for personal purposes only.  The user’s limited right to access, use and display the Website may be terminated for reasons including, but not limited to, a belief by J-W Power Company, in its sole discretion, that your use infringes on the copyright, trademark, patent, or other intellectual property rights of another, including those of J-W Power Company, and such use may subject you to payment of civil damages.

J-W Power Company provides the information on the Website without waiver of any rights or provision of any license thereto to any user.  Use of the Website and information contained therein constitutes your agreement to recognize these rights and to prohibit any unauthorized use.  J-W Power Company reserves all rights.  The parties agree the information on the Website shall remain the property of J-W Power Company.  Users of the Website may view and download material from the Website provided such material is used in a manner to maintain its proprietary and other protected status, for personal use, without broadcast in any form, and not used for any commercial purpose, including reverse engineering or creation of derivative works, sale, or distribution of any product or service.  The usage of any software on the Website is subject to this Agreement and to any user agreement that may accompany such software.

Nothing in this Agreement shall be construed to allow the user to use the Website or information therein in an unlawful, defamatory, or otherwise objectionable manner, or to encourage or assist others to do so.  Images and other information may not be placed on or transmitted through the Website without J-W Power Company’s express written permission.

The information placed on the Website has been chosen and thoroughly reviewed by J-W Power Company.  However, J-W Power Company does not guarantee or warranty the accuracy or completeness of such information, and such information may contain inadvertent errors or omissions that may be harmful or misleading.  Without acknowledging an obligation to do so, J-W Power Company may make corrections, updates, or revisions to the functionality or content of the Website at any time and without notice.  The information on the Website is provided ‘as is’, with all faults and without any representations or warranties, express or implied, of any kind, including, but not limited to, warranties of completeness, accuracy, merchantability, non-infringement or fitness for any particular purpose.  J-W Power Company shall not be liable for any direct, special, indirect, incidental, consequential or other damages related to, arising out of, or in connection with your use of the Website or any action or failure to act in connection therewith by J-W Power Company.

You may only use the Website, including any password protected portions thereof, in compliance with the security protections of the Website.  Your violation of, or attempts to violate, any security protection of the Website or to attack any part of the J-W Power Company digital systems, programs, or data may result in criminal or civil liability to you.  Any such violation, or attempted violation, will be carefully examined and reported to the authorities, as applicable.  Prohibited attacks on the J-W Power Company Website, systems, programs, and data include but are not limited to: (1) efforts to test the vulnerability of any J-W Power Company system or network; (2) unauthorized modification, hacking, or corruption of security or authentication measures; (3) transmittal of material that is intended to damage, destroy, or disrupt the J-W Power Company systems, programs, or data (including but not limited to viruses, Trojan horses, and similar programs or items); and (4) interference with any J-W Power Company system, program, data or information.

This Agreement is governed by the laws of the State of Texas, United States, without giving effect to any conflict of laws provision.  This Agreement constitutes the entire agreement between user and J-W Power Company with respect to the Website.  This Agreement was last updated on April 22, 2024.

J-W Power Company has developed this Privacy Policy (the “Policy”) to protect the privacy of individual users of the Website.  J-W Power Company is committed to the use of the information you share only as set forth herein.  This Policy is not intended to apply to any business or representatives or agents acting on their behalf.  Use of the internet and email communications carry inherent risks of exposure of personal information, and your use of such methods of communication, including the Website constitutes your acknowledgement, understanding, and consent to assume such risks.

Our Website automatically gathers information to allow it to communicate with your computer during your visit.  Certain information may be collected to help us with future website design and administration.  While this information cannot be used by us to personally identify you, it may include items such as the date and time of your visit to the Website, the number of your visits to the Website, the pages of the Website you visit, your computer’s IP address, and the type of web browser you use.

Your use of the Website does not require you to provide any private information (health status, race or ethnicity, age, criminal record, etc.).  By choosing to provide such private information to J-W Power Company through the Website for purposes of an employment application, you consent to J-W Power Company’s use of that information for the purpose intended and in accordance with this Policy.  However, J-W Power Company does not seek to gather any information from persons who are minors as that term is defined under applicable law.

J-W Power Company’s Website and actions arising therefrom are intended to comply with all applicable privacy laws, including but not limited to the California Consumer Privacy Act and the California Privacy Rights Act of 2020.  “Consumers,” for purposes of this Notice, are California residents, including every individual who is in California for other than a temporary or transitory purpose; or domiciled in California but is currently outside the state for a temporary or transitory purpose.

J-W Power Company’s products are not designed for household or other individual consumer use.  Any Personal Information (as defined below) that is collected from a Consumer is intended to be used for purposes of evaluation as a current or potential employee or contractor.  If J-W Power Company collects Personal Information from users acting in the capacity as a business representative, vendor, supplier, or customer, such information will not be treated as an employee’s Personal Information but will be handled in compliance with the CCPA, as applicable, and otherwise in accordance with the Privacy Policy.

For purposes of this Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular Consumer or household, including (but not limited to): Personal Identifiers (e.g., name, postal address, email address, online IP address, social security number); internet or other electronic network activity information; and employment, educational, and commercial information.

Your online IP address may be collected through your use of the Website, but it will not be sold.  Your online IP address may be disclosed for purposes of enforcing or investigating concerns with Website or software security.

J-W Power Company may collect: Personal Information, including your name, address, telephone numbers, date and place of birth, citizenship, email address, social security number, educational and work history, resume, references, and background screening results; and legally protected classification information including race, gender, marital status, and criminal history.  Such Personal Information will only be collected if it is voluntarily provided by you for the purpose of requesting J-W Power Company’s consideration of your application for employment.  Such Personal Information will be utilized to consider your employment application, potential employment, and retention, to monitor compliance with equal opportunity legislation, for periodic evaluation of our recruitment process, for emergency contact purposes, for administration of employee benefits and for legal purposes such as review and defense of hiring practices.

Your Personal Information may be shared with internal J-W Power Company personnel involved in the recruitment and hiring process, and with third party service providers with whom J-W Power Company has a contract for the purpose of obtaining operational assistance with employment application completion and review, tracking applications and offers, communication of offers, onboarding of employees, and/or access to payroll or benefits.  Your Personal Information may also be shared as required by applicable law, and with lawyers retained by J-W Power Company to assist in seeking legal advice or representation in connection with a demand or lawsuit.  Your provision of Personal Information to J-W Power Company does not obligate J-W Power Company to extend an offer of employment to you.  Your Personal Information will not be sold by J-W Power Company.  J-W Power Company will not discriminate against you for exercising any rights you may have under California Civil Code § 125.

You may submit a request for information regarding your Personal Information to the J-W Power Company Human Resources Department at 800-436-7808.  J-W Power Company may require you to verify your identity prior to responding.  Any request for deletion of Personal Information is subject to the exceptions specified under California law.
